General Terms and Conditions (AGB)
Stav Wagner – Private Chef & Events | As of: March 2026
1. scope of application
These General Terms and Conditions govern the business relationship between Stav Wagner, Gerechtigkeitsgasse 57, 3011 Bern (hereinafter “Provider”) and customers who book services in the area of private cooking events and catering (hereinafter “Customer”).
Deviating terms and conditions of the customer shall only apply if the provider has expressly agreed to them in writing.
2. range of services
The provider offers private cooking events, dinner experiences and catering services. The exact scope of services (menu, number of guests, location, date and special requests) is agreed individually and set out in a written order confirmation.
3. booking and conclusion of contract
A booking is considered binding as soon as the customer has received a written order confirmation from the provider. The contract is concluded upon receipt of the confirmation. Inquiries via the website form do not constitute a binding offer.
4 Prices and payment
All prices are quoted in Swiss francs (CHF) and include any material costs, unless otherwise agreed. As the supplier is not subject to VAT, no VAT is shown.
Terms of payment:
- 50 % deposit upon order confirmation
- 50 % final payment at least 7 days before the event
Additional costs (e.g. unforeseen additional material costs) will be invoiced by arrangement.
5 Cancellation and withdrawal
Cancellations must be communicated in writing by e-mail. The following cancellation conditions apply:
- More than 30 days before the event: full refund of the deposit
- 15-30 days before the event: 50% of the deposit will be retained
- Less than 15 days before the event: no refund
The provider reserves the right to cancel an event for good cause (illness, force majeure). In this case, the deposit will be refunded in full. Further claims by the customer are excluded.
6 Obligations of the customer
The customer undertakes to:
- Provide all relevant information (allergies, intolerances, number of guests) in good time and in full
- Provide a suitable and accessible venue for the event
- To provide the agreed kitchen and infrastructure
The customer shall be liable for any damage caused by incomplete or incorrect information.
7. liability
The provider is only liable in cases of gross negligence or intent. Liability for slight negligence and for indirect or consequential damages is excluded to the extent permitted by law. Liability for damage caused by allergies or intolerances that have not been reported to the provider is expressly excluded.
8 Copyright and photos
All content contained on the website and in offers (texts, photos, recipes) is protected by copyright and may not be used without the express written permission of the provider.
The provider reserves the right to use photos of events (without recognizable persons) for marketing purposes, unless the customer expressly objects.
9 Applicable law and place of jurisdiction
Swiss law applies exclusively. The place of jurisdiction for all disputes is Bern, Switzerland, unless otherwise agreed.
10. severability clause
Should individual provisions of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the original provision.
